A Florida deputy chief who was passed over for promotion to fire chief has lost a sex discrimination suit that claimed the position was awarded to a less qualified male. Philadelphia Captain Loses Race Discrimination Suit Over BC Test

A federal judge has dismissed a lawsuit filed by a Philadelphia captain who claims his test scores for promotion to battalion chief were tossed in retaliation for previous race discrimination claims he made. Captain James Williamson filed suit against the Philadelphia Fire Department last year claiming race discrimination and retaliation.

Reverse Discrimination Alleged in FDNY Medical Officer Promotion

Two FDNY physicians have filed suit against the city claiming they were passed over for a promotion on account of their race and age. Both doctors are white and in their 60s. Dr. Mark Spadaro and Dr. Ann Marchesano have served as City Medical Specialists for FDNY since 2007. Both are board certified physicians and each have over 30 years of experience.

Two settlements are in the fire law news today. In New Jersey, the Neptune Township Fire District No. 1 settled a race discrimination case filed by an African American firefighter who claims he was wrongfully denied additional compensation for extra duties and retaliated against when he complained.

Akron Fire’s Promotional Paralysis Case Settled

A nine-year long dispute that has held up promotions in the Akron Fire Department is finally over with news that the city has agreed to pay 23 firefighters $1.04 million in back pay and interest. The suit, Howe et al v. City of Akron, was filed in November, 2006 by 31 firefighters alleging that a 2004 promotional test was discriminatory against black candidates for lieutenant and white candidates for captain.

Oakland Captain Sues for Discrimination

A veteran captain with the Oakland Fire Department who claims he was passed over for promotion to battalion chief has filed suit alleging discrimination and retaliation based upon his Native American and Hispanic descent. Captain Joseph Torres claims that Oakland Fire Chief Teresa Deloach Reed purposefully bypassed him in favor of caucasian and black candidates.

A group of 140 St. Louis firefighters are suing over alleged race discrimination in the fire department’s promotional process. The 140 named plaintiffs are all members of F.I.R.E., and candidates for promotion to either captain or battalion chief. The suit alleges that in some cases their exam scores were deliberately altered.

Joseph Parkin claims that at 11:30 am on September 10th, 2010 he was told he was going to be promoted to battalion chief later that day at 5:00 p.m.

Montana City Challenges BCs Being in Firefighters Union

The City of Bozeman is challenging a ruling of the Montana Board of Personnel Appeals that three new battalion chiefs should be included within IAFF Local 613. The ruling issued last June concluded that all positions below the rank of deputy chief should remain within the bargaining unit.

Akron Facing Contempt for Promotional Paralysis Solution

The Akron Fire Department is facing possible contempt proceedings over its efforts to negotiate a new promotional process with Akron Firefighters, IAFF Local 330. The department has been prevented from promoting new officers by the US District Court for the Northern District of Ohio as it wrestles with a discrimination/reverse discrimination suit brought by 31 firefighters in 2006.
