Pension for Disabled NY Firefighter Restored by Appellate Court

A disabled New York firefighter has successfully prevailed in challenging his former city’s attempt to cut his disability payments.

Mount Vernon firefighter Michael Masullo was permanently disabled at a fire in 2000, and was granted a disability pension in 2004. In 2009, the city demanded that Masullo apply for disability benefits (which he had been receiving since 2004). When he did, they denied his benefits and cut his disability payments.

Masullo filed suit to restore his benefits and yesterday the New Your State Supreme Court’s Appellate Division agreed with him.

    Figures, a “Retro-active review of sorts and of course :

    “We have no record of your filing”

    As I tell my friends and co-workers and everyone else that I meet at conferences and training classes:

    Document everything as far as smoke, fire, EMS exposures and should the need arise to apply for a Disability Retirement, use an Attorney with the required background.

    And if need be, get the medical test’s you want that may back up your claims, eve if you have to pay for it yourself. In the long run, it may benefit you.

    Make sure everything is sent Certified-Return Mail and put everything in a nice large storage tub for easy reference.
