North Carolina Firefighters File Suit Against Fire Company

Three North Carolina firefighters with the East Lincoln Fire Department, Inc. have filed a class action lawsuit claiming the fire department failed to pay them overtime as required by the Fair Labor Standards Act. Adam Gant, Dale Bogle, and Brandon Auten filed suit in US District Court for the Western District of North Carolina.

The suit claims the fire department, as a private sector entity, was required to pay overtime after 40 hours per week. The firefighters were assigned to work schedule of one day on, one day off, one day on, two days off, one day on, and four days off. They received no overtime, just their annual salary divided into two-week payments, paid every two weeks.
